Act Preservation Institutional Reform in the area of Intellectual Property and Competition Disputes

On April 28, the Center for Intellectual Property, Tsinghua University School of Law, together with Center for Procedural Law, Tsinghua University School of Law, hosted seminar about act preservation system in the field of Intellectual Property and Competition Disputes. Honored judges in Supreme People’s Court, learned professors and excellent legal practitioners attended this conference.

Professor Wang Zhenming, dean of Tsinghua University School of Law showed his welcome to the distinguish guests and affirmed the significant of academic conference. Jin Kesheng, deputy Presiding Judge in Supreme People’s Court Intellectual Property Court, indicated that act preservation system would show a vital function on legal remedy and prevent irreparable injury which is worthy of efforts.

The seminar focused on the due procedure, removal and the scope of application of the rule of injunction in the afternoon. Practical issues were raised and responded by honored judges from Supreme People’s Court.In the end of the seminar, Zhou Xiang, Chief Judge in Supreme People’s Court Intellectual Property Court, concluded that legislation shall be exoteric for the reason that it lacks of practice in act preservation. In order to be a successful judicial interpretation, it shall balance the interests between parties.
