On Essential Issues of Patent Infringement
On the night of June 13, 2014 Tsinghua University Intellectual Property academic lecture was held in the conference room of the fourth floor of Ming Li Building . The lecture is sponsored by Intellectual Property Law Center and Tsinghua University-Microsoft Joint Research Center for Innovation and Intellectual Property.
Li Jian, the Supreme Court Judge, China Intellectual Property Research Association Deputy Secretary General, Chinese trial Theory Research Association Professional Committee of the governing intellectual property rights judge, brought a lecture on essential issues of patent infringement in this lecture. Liu Guowei , the deputy director of Beijing law and intellectual property agency; Li Sen, the partner of Jinchengtongda law firm; and Associate Professor Cui Guobin, the director of Intellectual Property Law Center, have attended this lecture and given some comment.
Li Jian at first introduced the new trends of court policies in patent infringement litigation through the specific cases, including “the exclusive rights about unable to protect”, “the exclusive rights of invalid”, “the litigation ending caused by patent invalidation” etc.
Then, Li talked several patent litigation hot issues, such as “technical features of defined function”, “principle of estoppel”, “indirect infringement”, “production and business purposes,” and “invention patent temporary protection period”.
In the course of lectures, the deputy director Liu Guowei, the lawyer Li Sen, and the associate professor Cui Guobin held a heated discussion from different academic circles and had numerous exchanges of views with the judge Li.
At the end of this speech, many students asked Judge Li Jian questions about patent infringement, which is also an animated and lively discussion.
