Recent Developments and Issues regarding the IP High Court in Japan

On March 27th, Intellectual Property Center in school of law, Tsinghua University, is honored to invite Professor Yoshiyuki Tamura, graduate school of law in Hokkaido University, to give a lecture about Recent Developments and Issues regarding the IP High Court in Japan. The lecture was successfully hosted by Miss. Jiang Ge and wonderfully remarked by Associate Professor Cui Guobin.

IP-Based Policy and Issues of IP High Court are the main topics penetrating the whole lecture. Reference to the successful example of U.S. IP policy, Professor Yoshiyuki Tamura introduced “IP-Based Policy” which was proposed by Japan Government in 2002. Following the model of U.S. Court of Appeals for the Federal Circuit, Japan passed Act for Establishment of the Intellectual Property High Court in 2004 and IP High Court was established in the next year. IP High Court unifies the right of jurisdiction for appeal and makes a difference to the efficiency and professionalization. With the interest about Japan IP system, Professor Yoshiyuki Tamura had an in-depth exploration about Double Track, Rules and Standards of IP High Court and Effects of Policy Orientation. In the end, Professor Yoshiyuki Tamura gave responses to questions, integrating scholars’ proposition, and mentioned ways except patent would play a more important role in encouraging innovation, like lead time and secret.

The comprehensive and systemic introduction of IP High Court in Japan caused enormous interest and attentions both of students in school of law and people in practice. By comparative study of mature IP court regimes, like in Japan and Germany, we can soberly aware the advantage and deficiency in China so as to improve our IP system to maturity. As a whole, the lecture achieved a complete success.
